1. The agreement
These terms are an agreement between [Company legal name] (“we”, “us”), registered at [Registered address] under [Company registration], and the person or business that installs Encore on a Shopify store (“you”).
Installing the app means you accept these terms. If you are installing on behalf of a company, you confirm you are allowed to bind it.
Your relationship with Shopify is governed by Shopify's own terms, not by these. Where the two conflict on something Shopify controls — checkout, billing mechanics, app distribution — Shopify's terms decide.
2. What Encore is
Encore adds blocks to two Shopify surfaces — the thank-you page and the order status page — through Shopify's Checkout UI extension system. The blocks available are product recommendations, discount codes, one-tap reorder and NPS or survey questions, together with a builder, analytics and A/B testing.
Encore is an add-on to your store. It is not a payment processor, not a fulfilment service, and not a legal or tax service.
3. Eligibility and your store
You need an active Shopify store and the authority to install apps on it. Encore runs on every Shopify plan; no Shopify Plus subscription is required.
You are responsible for what your store sells and for complying with the law where you sell it. We do not review your products, your offers or your discount terms.
4. Plans and the order cap
Every plan includes every feature. Plans differ on exactly one axis: how many orders showing a block they cover in a calendar month.

An order counts once, on the first surface where a block is shown to that customer. Seeing a block on both the thank-you page and the order status page for the same order counts as one, not two.
What happens when you reach the cap
Your blocks pause until the next month. They do not degrade, and you are not charged extra — there is no overage price, because there is no mechanism in the app to bill one. Your existing configuration and your historical data are untouched, and everything resumes automatically when the month rolls over. Upgrading at any point restores blocks immediately.
We may change prices or caps. Existing subscribers are given at least 30 days' notice before a change takes effect on their store, and a price increase never applies to a billing period already paid for.
5. Billing, trials and cancellation
All charges run through Shopify Billing and appear on your Shopify invoice. We never see or store your card details.
- Trials. Paid plans include a 7-day free trial. If you cancel before it ends, you are not charged.
- Approval. A subscription only becomes active when Shopify tells us it is. Reaching the confirmation screen is not enough — you can decline there, and until Shopify confirms, your store stays on the plan it was already on.
- Billing period. Subscriptions renew every 30 days through Shopify until cancelled.
- Cancellation. Cancel any time by uninstalling the app or changing your plan in the Shopify admin. Cancellation stops future charges; it does not refund the period already in progress.
- Refunds. Charges are non-refundable except where the law requires otherwise, or where we agree in writing that a charge was our error.
- Downgrades take effect at the next billing cycle. Downgrading to a cap below your current usage will pause blocks once the lower cap is reached.
If a plan you are on is retired, we move you to the tier carrying at least the headroom you already paid for — never to a smaller one.
6. Your configuration and content
Everything you put into Encore — block copy, survey questions, discount codes, settings — stays yours. You grant us only the permission needed to store it and render it on your storefront.
You are responsible for making sure it is accurate and lawful. In particular:
- A discount code shown in a block must be a real, valid discount in your Shopify admin. Encore checks that a code exists and is running, but it does not and cannot validate your commercial terms.
- Survey questions must not solicit sensitive personal data, and must comply with the privacy rules that apply to your customers.
- Any claim made in block copy — savings, delivery times, availability — is yours to stand behind.
7. AI recommendations
On paid plans, Encore may use a large language model to rank which of your products a recommendation block shows. What it receives is limited to product data — see the Privacy Policy for the exact fields.
Ranked output is a suggestion, not a promise. We do not warrant that any recommendation will convert, will suit a particular customer, or will outperform static rules. If the model is unavailable, too slow or not confident enough, Encore falls back to static rules — this is normal operation and is not a service failure.
You remain responsible for what your store offers. If a product should never be recommended, exclude it in your configuration rather than relying on the model to infer it.
8. Acceptable use
You agree not to:
- Use Encore to display misleading offers, fake urgency, or discounts you do not intend to honour.
- Attempt to bypass a plan cap or Shopify's billing.
- Send fabricated events to the API in order to distort analytics, A/B results or plan usage.
- Reverse engineer, resell or white-label the service without our written permission.
- Use the service to distribute malware, or to collect data from shoppers unlawfully.
- Interfere with the service's operation or its availability to other merchants.
We may suspend an account that breaches this section. Where the breach is not deliberate and not causing harm, we will contact you first.
9. Intellectual property
Encore, its name, its logo and its software remain ours. Nothing here transfers ownership; installing the app grants a non-exclusive, non-transferable right to use it on your store while these terms are in force.
Your products, brand and content remain yours. We may use anonymised, aggregated statistics — never attributable to one store — to improve the service.
If you would like us to name your store publicly as a user, we will ask first.
10. Availability and support
We aim for continuous availability but do not offer a contractual uptime guarantee on any plan. Maintenance, Shopify platform changes and third-party outages can all interrupt the service.
Encore is built to fail quietly rather than badly: if a block cannot be produced in time, it falls back to static rules or does not render. A block that does not appear is the designed failure mode, not a broken checkout — your store keeps taking orders regardless of Encore's state.

11. Warranties and liability
Encore is provided “as is”. To the fullest extent the law allows, we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement.
We do not warrant that using Encore will increase your revenue, your conversion rate or your average order value. Any figures on our website are illustrative examples, not forecasts.
To the fullest extent the law allows, our total liability for any claim arising out of these terms is limited to the fees you paid us for the service in the three months before the claim arose. We are not liable for lost profits, lost revenue, lost data or indirect and consequential losses.
Nothing here limits liability that cannot be limited by law, including liability for fraud, or for death or personal injury caused by negligence.
12. Termination
You can end this agreement at any time by uninstalling Encore. We can end it if you breach these terms, or on 30 days' notice for any other reason.
On uninstall, Shopify revokes our access to your store and we delete the stored credentials immediately. Your data is erased when Shopify sends the shop redaction request roughly 48 hours later — a window that exists so a reinstall inside it keeps your blocks. The details are in the Privacy Policy.
Sections 9, 11 and 13 survive termination.
13. Changes, governing law and contact
We may update these terms. Material changes are notified to installed merchants before they take effect, and the effective date above is updated. Continuing to use Encore after that date means you accept the new version.
These terms are governed by [Governing law], and disputes are subject to the exclusive jurisdiction of [Courts], without prejudice to any mandatory consumer protections available to you locally.
If any clause is found unenforceable, the rest stays in force.
